Federal Judge Sends Yonkers Ex-Con Caught With Gun Back To Prison For 6+ Years

Because there's no parole in the federal prison system, 29-year-old Francisco Vallejo must serve the entire six years and four months for being a (three-time) convicted felon in possession of a firearm.

U.S. District Judge Susan D. Wigenton convicted him of the weapons charge last July following a four-day bench trial that included surveillance video of him stashing a loaded .25-caliber handgun in a garbage can.

City police responding to a June 7, 2015 call of shots fired detained Vallejo, discovered the hidden gun, then found the surveillance video, U.S. Attorney Craig Carpenito Carpenito said.

They also reported finding gunpowder residue on his hands, the U.S. attorney said.

In addition to the prison term, Wigenton sentenced Vallejo to three years of supervised release.

Carpenito credited special agents of the Newark Field Division of the Bureau of Alcohol, Tobacco, Firearms and Explosives, Passaic and the Passaic County Sheriff’s Office for their roles leading to the guilty verdict, secured by Assistant U.S. Attorney J. Brendan Day and Senior Litigation Counsel R. Joseph Gribko of his Criminal Division in Trenton.
